By accessing or using https://sytelift.com (the "Website"), you agree to these Terms of Service (the "Terms") and acknowledge our Privacy Policy. If you do not agree, do not use the Website.

1) Definitions

For purposes of these Terms:

• "Content" means text, images, graphics, audio, video, code, and other materials made available on the Website.
• "User" / "you" means any person who accesses or uses the Website.
• "We" / "us" / "our" means Frostwave Labs Inc.
• "Third-party services" means services and sites not owned or controlled by us, including linked sites and providers used for enabled Website features.

2) Who we are

The Website is owned and operated by Frostwave Labs Inc.

The Website may also use the brand or site name SyteLift. Our mailing address is 2967 Dundas St. W. #992, Toronto, ON M6P 1Z2.

3) Eligibility

You must be at least 13 years old, or the age of majority in your jurisdiction if higher, to use the Website. By using the Website, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

4) Website content

Content on this Website is provided for general informational, entertainment, marketing, and educational purposes only and is not professional advice, including legal, medical, financial, tax, or other regulated advice. You should not rely on any Content as a substitute for professional advice tailored to your situation.

We do not represent or warrant that any Content is current, complete, or error-free, and we may change or remove Content at any time.

Some Content may be generated or assisted by automated systems, including artificial intelligence, and may contain errors or omissions. You agree to independently verify any Content before relying on it.

We do not guarantee any specific outcomes or results from your use of the Website or Content.

5) Intellectual property

Unless otherwise stated, we own or license the content on the Website, including text, graphics, logos, and design.

You may view and print content for personal, non-commercial use. You may not reproduce, distribute, sell, or create derivative works from our content without permission.

6) Copyright infringement

We respect the intellectual property rights of others. If you believe material located on or linked to by the Website violates your copyright, contact us at info@sytelift.com with:

• Identification of the copyrighted work
• Identification of the material you believe is infringing
• Your contact information
• A statement that you have a good faith belief that the use is not authorized

We will respond as required or appropriate, including by removing the infringing material or disabling links to it.

7) Acceptable use

You agree not to:

• Use the Website in any unlawful way
• Attempt to disrupt or damage the Website, including scraping at abusive rates, probing, DDoS, malware, or similar activity
• Circumvent security or access restricted areas
• Use automated means to access the Website in a manner that imposes an unreasonable load or bypasses access controls, unless you have our express written permission

This does not apply to generally accepted search engine crawling or indexing. We may suspend or block access if we reasonably believe you are misusing the Website.

8) Third-party links and services

The Website may link to or use third-party websites and services. We do not control them and are not responsible for their content, policies, practices, availability, or security. Your use of third-party sites and services is at your own risk.

Third-party services may have their own terms and privacy practices. You are responsible for reviewing and complying with those terms.

9) Applying for a free website upgrade

Applying is free, requires no payment details and creates no purchase obligation. We are selective: we review each application and email a decision within 2 business days, and we may decline any application. If you are accepted, we build your complete custom website at our own cost and send it as fast as possible; there is no delivery deadline. You pay $2,995 once, only if you love it and choose to keep it. If you pass, nothing is owed. Applying through a Google Ads lead form hosted by Google is the same application. We analyze only your public website and never change your current site. Until you buy it, your new website is hosted on a SyteLift address, marked so search engines do not index it, and anyone with the link can view it. It remains owned by SyteLift, including its code, design and copy: you may view and share it to decide, but may not copy, publish or reuse it. We may retire an unpurchased website after owner review.

10) Packages and prices

SyteLift serves US businesses and charges in US dollars, once, with free hosting and no monthly fees. Standard, $2,995: a custom website of up to 6 pages built from your existing content, mobile-first and fast. Premium, $4,995: everything in Standard, up to 12 pages, professional copywriting for every page, custom graphics and photo editing, and a priority build. Accepted applicants pay the price in their offer, normally $2,995. We sometimes show an exclusive price, such as $1,995, to visitors who arrive through one of our ads; the price confirmed in your offer is the price you pay. Taxes are added where applicable. Payments are processed by Stripe.

11) Buying directly

You can skip the application and buy Standard or Premium through checkout on our website. Payment is due upfront, at checkout. After payment we collect what we need from you, build your site as fast as possible and guide you through connecting your domain. There is no fixed delivery deadline. The same refund policy below applies.

12) Your responsibilities

Provide accurate business, billing and domain details and use a payment method you are authorized to use. You are responsible for rights to materials you supply and for your domain registration. Stripe handles payment details under its own terms and privacy practices. Review your new website before you decide to keep it.

13) Ownership, export and free hosting

After purchase, you own your site and may move it any time. Email info@sytelift.com for a free static export. You keep your domain registered in your name and pay your domain registration provider directly. Free hosting includes serving your static website on Cloudflare with HTTPS. No monthly fees, ever. If SyteLift ever shuts down, we give 60 days' notice and a free copy of your site. Moving your site ends our hosting responsibility; your new host may charge its own fees. Third-party images, fonts and other licensed assets remain subject to their licenses.

14) Support after delivery

After delivery, we fix real hosting issues with your SyteLift-hosted site. Ongoing design revisions, content updates and new functionality are not included. Before purchase, reply to discuss your new website; requested changes are reviewed by the owner. Email info@sytelift.com for help.

15) Connecting your domain

After verified payment, the same offer page guides you through connecting your domain with provider-specific DNS instructions and live record checks. We never ask for your registrar password or change email records (MX, SPF or DKIM). When the required domain and certificate checks pass and the production site is ready, your site goes live automatically. DNS changes take time to spread and are outside our control, so interruption-free switching is not guaranteed. Email info@sytelift.com for help.

16) Refund policy

Not happy within 14 days of your site going live? Email us for a full refund, and we take the site down. Send your request to info@sytelift.com with your business name and domain. Refunds are returned through the original payment method; allow 5-10 business days after issuance. We take down the SyteLift-hosted site as part of the refund.

17) No guaranteed business outcome

We design for clarity, speed, accessibility and useful customer paths. We do not guarantee traffic, rankings, revenue, leads, sales, conversion rates, advertising performance or other business results.

18) User content

The Website does not currently accept public user-submitted content, such as comments. If this changes, we may update these Terms.

19) Disclaimer of warranties

THE WEBSITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Any reliance on the Website or Content is at your own risk.

20) Limitation of liability

To the maximum extent permitted by law, Frostwave Labs Inc. will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of, or inability to use, the Website.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any liability or remedy preserved by mandatory consumer law. If liability cannot be excluded, it will be limited only to the extent permitted by applicable law.

21) Indemnity

You agree to indemnify and hold harmless Frostwave Labs Inc. from claims, damages, liabilities, and expenses arising out of your misuse of the Website or violation of these Terms.

This includes claims arising from:

• Your violation of any applicable law or regulation
• Your infringement or alleged infringement of any third-party rights
• Your use of third-party products or services linked from the Website

22) Changes to the Website or Terms

We may change or discontinue the Website at any time. We may update these Terms by posting an updated version with a new effective date. Changes apply prospectively from that date. Where applicable law requires notice or consent, we will provide it.

23) Termination

We reserve the right, without notice and in our sole discretion, to terminate your right to use the Website, and to block or prevent your future access to and use of the Website, if you violate these Terms or for any lawful reason.

All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

24) Governing law and consumer rights

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law rules.

This choice of law does not deprive you of mandatory consumer protections that apply where you live.

25) Dispute resolution

Before filing a claim, you agree to contact us at info@sytelift.com and make a reasonable attempt to resolve the dispute informally. This does not prevent either party from seeking urgent relief or using a court, tribunal, regulator, consumer-protection body, or dispute process available under applicable law.

26) Severability; waiver; assignment

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

27) Entire agreement

These Terms constitute the entire agreement between you and us regarding the Website and supersede all prior or contemporaneous agreements, understandings, or representations, whether written or oral.

No third-party beneficiaries: These Terms are for the benefit of you and us only and do not create third-party beneficiary rights.

Headings and interpretation: Section headings are for convenience only and do not affect interpretation. The word "including" means "including without limitation".

28) Force majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, transportation shortages, fuel shortages, energy shortages, labor shortages, or material shortages.
